Current nullification efforts in Missouri 2012

TSA Missouri Legislation (naked body scanners, invasive pat downs) – No current Legislation

Health Care Freedom Act: SJR39 – Prefiled 12-21-11, last action was 1/5/2012 when it was given a second read and referred to S General Laws Committee. The act prohibits laws interfering with freedom of choice in health care. Please see SJR39 for more information.

Food Freedom Legislation (supports locally grown organic food): No current Legislation

Intrastate Commerce Legislation (would seek to nullify federal laws and regulations that violate such limitations by regulating commerce and other activities that are solely intrastate): No current Legislation

Health Care Nullification (would seek to directly nullifies the “Patient Protection and Affordable Care Act” signed into law by Barack Obama on 03-23-10): No current Legislation

Constitutional Tender Legislation (would seek to nullify federal legal tender laws in the state by authorizing payment in gold and silver or a paper note backed 100% by gold or silver): No current Legislation

Firearms Freedom Act: HB361 - Introduced 01-27-11. On 03-17-11 it passed in the House, 118-37. Placed on Informal Calendar, with hearing not scheduled nor is bill currently not on a House calendar.

10th Amendment Resolutions (These non-binding resolutions, often called “state sovereignty resolutions” do not carry the force of law. Instead, they are intended to be a statement of the legislature of the state.): On 04-08-10 HCR25 was passed in the House, 104-49. HCR25 – claims “sovereignty for the state under the Tenth Amendment of the United States Constitution for all powers not otherwise enumerated and granted to the federal government under the Constitution.”

Defend the Guard (would reassert the authority of the Missouri Governor over guard troops): No current legislation

Sheriffs First Legislation (A “Sheriffs First” bill would make it a state crime for any federal agent to make an arrest, search, or seizure within the state of Missouri without first getting the advanced, written permission of the elected county sheriff of the county in which the event is to take place): No current legislation

Cap and Trade/EPA Nullification Legislation: No current legislation

State Sovereignty and Federal Tax Funds Act (Require that all federal taxes come first to the state’s Department of Revenue): HB310 was introduced 1-25-11 and referred to “Ways and Means”, with a hearing not scheduled, nor is the bill on the House calendar.

Tenth Amendment Bills (contains language affirming the sovereignty of the people of Missouri and to create a commission or a committee to review the Constitutionality of acts emanating from the federal government): SJR45 was introduced 1-09-12
